1.              Information about us and how to contact us

1.1            Who we are. We are Deutsch Auto Centre Ltd of Unit 1a Burnett Road, Darenth Industrial Park, Erith, DA8 2LG Company number 14575847 registered VAT number is 434919573

1.2            How to contact us. You can contact us by telephoning our customer service team at 01322 341634 or by writing to us hello@deutschautocentre.co.uk 

1.3            How we may contact you. If we have to contact you we will do so by telephone or by writing to you at the email address or postal address you provided to us in your order. 

1.4            "Writing" includes emails. When we use the words "writing" or "written" in these terms, this includes emails.

 

2.              Our contract with you

2.1            How we will accept your order. Our acceptance of your order will take place when we tell you that we are able to provide you with the goods and/or services which we will also confirm in writing to you, at which point a contract will come into existence between you and us. 

2.2            If we cannot accept your order. If we are unable to accept your order, we will inform you of this. This might be because we have identified an error in the price or description of the goods and/or services or because we are unable to meet a delivery deadline you have specified. 

2.3            Deutsch Auto Centre Ltd will not be held responsible for any pre-existent and unforeseen defects to the vehicle which is the subject of this contract.

2.4            Our acceptance of your order will take place when we write to you to accept it OR we tell you that we are able to provide you with the product(s) and services, which we will also confirm in writing to you at which point a contract will come into existence between you and us. If we are unable to accept your order, we will inform you of this and will not charge you for the goods and/or services. This might be because the goods are out of stock, because we have identified an error in the price or description of the product or because we are unable to meet a delivery deadline you have specified. 

3.              the Warranty.

3.1            Rebuilt engines supplied by Deutsch Auto Centre Ltd are supplied a 12 month Warranty from the date of sale subject to the following terms.

3.2            Rebuilt engines supplied and installed by Deutsch Auto Centre Ltd are supplied with a 12000 mile Warranty from the date of installation subject to the following terms:

3.3            During the Warranty period, Deutsch Auto Centre Ltd will make good any defect, and if unit was fitted by us, will cover parts and labour costs providing that: 

(a)         The defect was not caused by abuse, misuse, lack of fluids, incorrect fluids, failure of belts, gaskets etc.; or neglect, accident, racing, pacing, speed trials, or by any other modification or alteration, repair or attempted repair, except for any carried out with Deutsch Auto Centre’s written consent: and 

(b)         The defect is reported to Deutsch Auto Centre in writing (or by telephone followed by confirmation in writing) immediately after the defect appears: and 

(c)         Unless fitted by Deutsch Auto Centre Ltd, the engine which is this subject of this Warranty must, as soon as practicable, be returned to Deutsch Auto Centre Ltd for examination, repair or replacement within the terms of this Warranty.

 

4.              the terms of the Warranty.

4.1            Rebuilt engines [meaning block and cylinder head] supplied Deutsch Auto Centre Ltd are 'bare' without any ancillary parts, empty of oil or fluids and must have had the cam/timing tensioner kit, belts, seals and gaskets, oil, oil filter, water pump and spark/glow plugs replaced with new parts.

4.2            Following fitting the engine whether by Deutsch Auto Centre Ltd or not 

(a)         The Engine must not exceed 3,000 RPM / 70mph for first 500 miles: and 

(b)         The Vehicle must be returned to Deutsch Auto Centre Ltd for an oil and genuine oil filter change after 500 miles of use: and 

(c)         The Engine must be serviced in accordance with Deutsch Auto Centre Ltd service schedule every 6 months or 6,000 miles [whichever sooner] thereafter.

4.3             Servicing costs £125 + VAT for Petrol vehicles up to 2000cc. Diesel and Petrol vehicles over 2000cc cost £165 +VAT.

4.4            Failure to adhere to the terms of the Warranty will render the Warranty void. Deutsch Auto Centre Ltd will not be liable for any damage caused to the engine as a result of the failure to adhere to these terms and conditions.

4.5            The return of the Vehicle and/or engine which is the subject of the Warranty will be at the customer’s own expense and Deutsch Auto Centre Ltd will not be liable for any transport or labour costs incurred. 

4.6            If the engine has been fitted by us, the vehicle must be returned to us at the customer’s own expense. Deutsch Auto Centre Ltd will not consider any claim(s) in regard to labour costs or any recovery/hire charges incurred in the fitting, removal or changing of parts supplied by us.

4.7            The engine buyer is responsible for the cost of maintenance items including, but not limited to, anti-freeze, filters, elements and belts replaced during warranty repairs.

4.8            This Warranty is non-transferable.

 

5.              Retention of Title. 

5.1            Unless otherwise stated in writing by Deutsch Auto Centre Ltd ownership (title) to any goods supplied by Deutsch Auto Centre Ltd remain with Deutsch Auto Centre Ltd until such time as they are paid for in full. Deutsch Auto Centre Ltd lay claim to repossess any such unpaid goods as we deem necessary and at its discretion.

 

6.              How to tell us about problems.

7.              We can charge interest if you pay late.

7.1            If you do not make any payment to us OR If we are unable to collect any payment from you by the due date we may charge interest to you on the overdue amount at the rate of 8% a year above the bank base lending rate This interest shall accrue on a daily basis from the due date until the date of actual payment of the overdue amount, whether before or after judgment. You must pay us interest together with any overdue amount.

 

8.              Our responsibility for loss of damage suffered to you

8.1            We are not responsible for the cost of repairing any pre-existing faults or damage to your vehicle that we discover while providing the services.  

 

9.              Limitation of Liability  

9.1            We will have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity, loss of reputation, credit or goodwill, or any indirect or consequential damages whatsoever.

 

10.            Other important terms

10.1         This contract constitutes and entire agreement between the parties and supersedes and extinguished any and previous agreements, promises, assurances, warranties and/or representations whether written or oral. 

10.2         We may transfer this agreement to someone else. We may transfer our rights and obligations under these terms to another organisation. We will always tell you in writing if this happens and we will ensure that the transfer will not affect your rights under the contract. 

10.3         Nobody else has any rights under this contract This contract is between you and us. No other person shall have any rights to enforce any of its terms. 

10.4         If a court finds part of this contract illegal, the rest will continue in force. Each of the paragraphs of these terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.

10.5         Even if we delay in enforcing this contract, we can still enforce it later. If we do not insist immediately that you do anything you are required to do under these terms, or if we delay in taking steps against you in respect of your breaking this contract, that will not mean that you do not have to do those things and it will not prevent us taking steps against you at a later date. For example, if you miss a payment and we do not chase you but we continue to provide the products, we can still require you to make the payment at a later date.

10.6         Which laws apply to this contract and where you may bring legal proceedings. These terms are governed by English law and you can bring legal proceedings in respect of the vehicle and/or products in the English courts.
